Terms of use

These general terms and conditions (“Terms”) apply to use of the Affirmations by Napolill app, the napolill.com website, and related services (e.g. account access, optional cloud sync), except where mandatory law provides otherwise.

By installing or using the app or the website, you agree to these Terms. If you do not agree, you must not use the app or the website.

2.1 Service scope and fees

As of this version: use of the app is currently free of charge; no fees apply for the core features described here. The app may refer to future paid offerings – billing will only occur after separate, clear notice and via the relevant app stores (Apple/Google) once such offerings are introduced. The respective store terms will then apply in addition to these Terms.

2.2 Your responsibilities

• You are responsible for using the app properly
• Use is at your own risk
• You agree not to misuse the app
• Reverse engineering or decompiling the app is prohibited

2.3 Age restriction

The app is intended for users aged 16 and over. For minors we recommend use under adult supervision.

In particular, the Affirmations by Napolill app offers:

• Recording and playback of personal affirmations
• Optional Solfeggio soundscapes as background audio (effects are scientifically disputed; purely optional)
• Topic and mood selection (mood themes, mood tracking, calendar view)
• Progress tracking and badges
• Optional cloud sync of your data (e.g. settings, progress, mood logs, playback history; transmission over encrypted connections, e.g. via Firebase)
• Optional user account (e.g. sign-in with email, Google, or Apple) for device linking and sync
• Optional profile picture and your own audio recordings (affirmations)

4.1 No health advice

The app is a supportive wellness tool. For health concerns, always consult a qualified physician or therapist.

4.2 Light and sensory features

Where the app offers a light pulse or flash feature (e.g. synced to rhythm), it is voluntary. Do not use it if you have epilepsy, light-triggered migraine, or comparable conditions. Use is at your own risk.

4.3 Limitation of liability

We are liable only for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law.

4.4 Data loss

We recommend regular backups of your data. We are not liable for data loss except in cases of intent or gross negligence.

All content of the Affirmations by Napolill app (text, images, audio, code) is protected by copyright.

• You receive a non-exclusive, non-transferable right of use
• Commercial use without written permission is prohibited
• Affirmations you create yourself remain your property
• Solfeggio frequencies may only be used within the app as provided

We may change these Terms at any time. We will inform you in good time of material changes:

• via a notice in the app (e.g. on launch or in settings) – without requiring operating-system push notifications
• by email (if you have given us an address)
• on this website at napolill.com/terms

We will explain material changes where reasonably possible. Continued use after a change takes effect may constitute acceptance where permitted by applicable law and we have informed you accordingly. If you do not agree, stop using the service and – if offered – delete your account or the local installation.

7.1 Applicable law

The laws of the Republic of Austria apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of the country where you habitually reside as a consumer remain unaffected.

7.2 Venue

If you are a merchant within the meaning of commercial law, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these Terms is Mistelbach, Austria. As a consumer, you may bring proceedings at the courts having jurisdiction under EU consumer law or national law; we may sue consumers at their place of residence where provided by law.

7.3 Severability

If individual provisions are invalid, the remaining provisions remain in effect.
